Those blood alcohol tests finally came back, and it can safely be concluded that the off-duty cop that crashed on the Bronx River Parkway was intoxicated at the time. In fact, Hoyong Kim's blood alcohol content was 0.16—twice the legal limit. Kim and Officer Edwin Paulino had allegedly been out until 5 a.m. at a birthday party, where Kim was named the designated driver.

Passenger Melina Ramirez said Kim told her, "Don't worry, we're cops. You can trust us," but crashed into a guard rail on the Parkway. He and Paulino both died in the crash, and the four other passengers were seriously injured. Police initially blamed the crash on "driver inattentiveness." Officer Paulino had a BAC of .21 at the time of the crash, which is just one more DWI cop story seen in the past year.
