Remember Ellen Massey? She's the Mets fan that had her back broken while watching an April game at Shea Stadium. Sitting in the upper deck, Massey had an "oversized" man, who may have been drunk fall on her, breaking one of her vertebra. Now, Massey, who had two steel rods placed in her back, is suing the Mets,, their concessions vendor Aramark, the service union that includes stadium security, and "John Doe," the man that fell on her. The man has not been found yet or come forward.
Massey's suit alleges that stadium employees "knew or had reason to know from his behavior that he was already intoxicated," and it's because of their negligence that he became "unruly, uncoordinated and fell." Her lawyer says that she's still in pain and will need another operation. Despite all her pain, the lawyer also says, "She's still a fan and she wants them to win the World Series."
The Mets believe the suit has no merit and Aramark said they were still reviewing the lawsuit. The suit seeks unspecified monetary damages. Aramark previously lost a lawsuit stemming from a 1999 incident when a drunk man paralyzed a girl after a football game at Giants Stadium. That verdict was overturned in 2006 by a New Jersey appeals court.
