In December, Michael Dion suffered every New Yorker's worst nightmare after he found himself stuck between a subway and the extendable platform in the Union Square station, an accident which left him hospitalized for a month with a crushed pelvis and severe damage to his abdominal organs. His lawyer has claimed he wasn't intoxicated at the time of the accident, but a new MTA incident report (below) says, "Witnesses reported seeing him staggering about the platform while holding a can of Budweiser."

The original NYPD report about the incident claims that Dion appeared intoxicated, but Dion's lawyer claims Dion simply tripped and fell into the tracks, and then was crushed as he was trying to climb out. "He was not slugging beer on the platform," Dion's lawyer, Jay Dankner, told the Post. "[Dion] refutes anybody saying he was carrying an open can of beer in a bag or not on the platform." However, he did reportedly have several "thimble-sized" mixed drinks at a promotional event a few hours before the incident.
