Sen. Hiram Monserrate (D-Queens), the most unifying man in the Senate, will go neither quietly nor gently into that dark night. A special Senate panel recommended that he be expelled or censured after being convicted of a misdemeanor assault. Never one for inaction, Monserrate is planning on going on the offensive, legally challenging any effort to expel him from the Senate.
According to the Daily News, Monserrate will seek an injunction almost immediately after the special Senate's report is officially released in the next days, in an attempt at preventing a Senate vote from ever occurring. The vote on sanctions against Monserrate would likely take place within two weeks after the report is released. According to one anonymous Senator who has seen the draft report, "If the motion to expel him goes to the floor, I think it passes."
