The Manhattan DA's office will not pursue rape charges against Greg Kelly, a Fox 5 co-anchor and son of NYPD Commissioner Ray Kelly. "The facts established during our investigation do not fit the definition of sexual assault crimes," Cyrus Vance Jr.'s office wrote in a letter to Kelly's lawyer that was obtained by the New York Times.

Kelly had been accused of raping a 28-year-old paralegal in her downtown office building after the two had drinks in a bar at the South Street Seaport. The incident allegedly happened in October, but the accuser did not approach police until January 24 of this year. A spokeswoman for the DA told the Times that the decision comes after a "thorough investigation" that included analyzing security logs, speaking to witnesses, and looking at text messages, receipts and phone records.

It's unclear whether Kelly was ever questioned by investigators about the incident, but plenty of sources came forward during the two week investigation to assure the media that Kelly's encounter with the woman was consensual.
