Oswind David, who as we reported yesterday was jailed for almost five years despite the charges against him being dropped, will be released pending $75,000 bail. "It's what I have been praying for," David told reporters. The Brooklyn DA's office continues to proclaim David's guilt because "a jury would have convicted him of a lesser charge of second degree assault," in a rare legal maneuver called a "Minority Report."
While Bloomberg cuts salt and pepper from David's diet, the D.A. will continue to pour money into pursuing a case that hasn't existed for five years. Not to mention the money that will be spent defending the city from the inevitable civil suit for robbing this man of 4.5 years of his life. Ahhh, guv'ment. Naturally his original trial attorney, David Epstein, wouldn't talk to reporters, but his current lawyer has called the ordeal a "horrifying situation."
