Actress Amanda Peet's husband and screenwriter David Friedman (professional name David Benioff) testified yesterday at the trial of Henry Santos, a career criminal who was accused of breaking into the couple's apartment and stealing computer equipment and $900 of Peet's jewelry. The couple's nanny came home to find Santos holding a jewelry box in the hallway. He allegedly said, "What's up, bitch?" before bolting out of the apartment. The Daily News reports Santos claimed it was his apartment before he left.

Amanda Peet was three months pregnant at the time, and her husband says "she was panicked" after learning of the break in. Police say Santos used a crowbar to enter the apartment through a skylight, and Friedman later found a boot print on top of a bookshelf. Unfortunately, cops hadn't found the boot print when searching the apartment, and weren't able to use it as evidence in the case. Santos allegedly went through their 2-year-old daughter's drawers before fleeing the scene, but his lawyers claim there isn't enough physical evidence to tie him to the crime. His record includes 30 drug, weapon or trespassing arrests, and he faces up to 15 years in prison if convicted.
