The out-of-towner who allegedly stole a box truck after partying with his famous uncle, and then crashed into a M14 bus, killing the bus driver, was hit with vehicular homicide charges yesterday. Officials say Domonic Whilby also had a 0.18 blood alcohol level, over twice the legal limit.
Whilby had been out with his uncle, model Tyson Beckford, celebrating the birthday of a Victoria's Secret model at Butter and 1OAK. Whilby, a 22-year-old from Georgia, apparently got kicked out of 1 OAK (or another club) for being too "handsy" with female patrons. Then he passed out a Meatpacking District hotel and was kicked out. After allegedly being unable to find transportation, he happened upon a parked Isuzu box truck for 18 Rabbits Granola at 355 West 16th Street at 5:30 a.m. on Wednesday, February 12.
The 18 Rabbits driver said that Whilby took the truck from the loading dock. From the criminal complaint: "As the defendant drove out of the loading dock, the defendant almost struck the informant with the Isuzu truck, and hit the wall of the loading dock causing the Isuzu truck's side door to fall off. The informant also observed the defendant drive the Isuzu truck into another truck and yellow taxi parked on West 16th Street as he exited out and away from the loading dock."
Prosecutors say that witnesses saw the stolen truck blow lights at West 16th Street and 8th Avenue and then at West 14th Street and 7th Avenue. At 7th Avenue, the box truck struck the tandem M14 bus. The bus then went flying into the sidewalk scaffolding, and bus driver William Pena, 49, was ejected through the windshield and was found dead under the bus.
According to the Daily News, sources examined video from inside the bus, "Just minutes before the wreck, about 10 riders exited the bus at a stop on the crosstown M14 route, the source said. 'By the grace of God, there was just one rider on the bus,' the source said.
The video showed the lone passenger flying out of his seat as shattered glass and smashed pieces of scaffolding tore through the vehicle." Besides that passenger, a coffee vendor, a pedestrian and a person on a scooter were injured.
Whilby, who also faces manslaughter, vehicular manslaughter, assault, and DWI charges, is being held without bail.
