The dulcet tones of Mister Softee's iconic jingle shall henceforth only sound from sanctioned trucks if an injunction issued by a federal judge is followed. Yesterday, Judge Joan Azrack followed through on a lawsuit filed by the soft serve purveyor to stop the proliferation of imitators that have been duping ice cream-seeking customers. The Post reports that Gus Toufos and other rogue operators are now prohibited from operating any business that even casually resembles Mister Softee.

Instead of capitulating, Toufos allegedly ignored the trademark infringement case entirely when it was first brought against him in 2005. He and other rogue trucks continued to use Mister Softee's blue-and-white color scheme, which they'll now have to get rid of. In addition to ditching his branding, Toufos has also been compelled to cover legal fees for Mister Softee to the tune of $8,800. That's a hell of a lot of chocolate dips.
